Steve Bliss:

You’re right, Maria. Trusts are powerful instruments that can significantly minimize the need for probate. One common type is a revocable living trust. Essentially, you transfer your assets into a trust during your lifetime, and you retain control over them. You can amend or dissolve the trust while you’re alive. Upon your passing, the trust assets are distributed to your beneficiaries according to your instructions, bypassing the probate process altogether.

Sometimes people underestimate the importance of updating their trust documents regularly. Life circumstances change – marriages, births, divorces – and it’s crucial that the trust reflects those changes. I remember one client whose trust hadn’t been updated in over a decade. When they passed away, there were significant complications because their intended beneficiaries had changed.

Consequently, I always emphasize to clients the importance of reviewing their trusts every few years or after major life events.
