Can you walk us through one of the key steps in the probate process?

Certainly. One crucial step is “Marshaling the Estate Assets.” This involves comprehensively identifying and inventorying all assets belonging to the deceased person’s estate.

We begin by reviewing financial records, bank statements, investment accounts, property deeds, insurance policies, and any other relevant documentation. This meticulous process ensures that no asset is overlooked. Consequently, we create a detailed inventory of all the estate’s holdings.

Moreover, we determine the fair market value of each asset at the time of death. This valuation is essential for accurately calculating estate taxes and distributing assets according to the will or intestate succession laws.

Notwithstanding this careful approach, there have been instances where uncovering hidden assets posed a challenge. Once, I worked with a family where the deceased had stashed away a significant sum of cash in a safe deposit box unknown to his heirs. Discovering this asset required diligent detective work and ultimately brought fairness to the distribution process.

Ordinarily, most estates have fairly straightforward asset identification. However, situations like the one I mentioned highlight the importance of working with an experienced probate attorney who can navigate complex financial circumstances.

How common are these types of hidden assets?

While instances of hidden assets aren’t incredibly frequent, they do occur more often than you might think. A 2018 study by the National Endowment for Financial Education found that nearly 40% of Americans don’t discuss their finances openly with family members.
