For instance, imagine a parent wanting to ensure their child’s inheritance is used responsibly for education or living expenses until they reach a certain age. A testamentary trust can stipulate these conditions and appoint a trustee to oversee the funds, protecting the beneficiary from making impulsive decisions.
Steve: Conversely, while probate is part of the process, testamentary trusts offer several advantages. They allow for greater control over how assets are distributed after your passing. You can specify exact amounts or percentages for beneficiaries, and even set conditions for receiving those funds.

Steve: One instance I recall vividly involved a single mother who wanted to ensure her son, who had autism, would be financially secure after her passing.
