What exactly is a conservatorship, and when might someone need one?
Ted: “Simply put, a conservatorship is a legal arrangement where a court appoints someone to manage the affairs of another adult who is deemed unable to do so themselves. This could be due to various reasons, such as advanced age, mental illness, or severe disability. The person appointed by the court is called the conservator, and they have a fiduciary duty to act in the best interests of the individual under their care, known as the conservatee.”
Let’s delve into the process. How does one actually establish a conservatorship?
Ted: “Establishing a conservatorship involves several steps. First, a petition needs to be filed with the probate court outlining why the conservatorship is necessary. Notice must then be given to the proposed conservatee and their family members. The court will typically appoint an investigator to assess the situation independently, and a medical or psychological evaluation may also be required to determine the individual’s capacity. Finally, there’s a hearing where a judge reviews all the information presented and decides whether to grant the conservatorship.”
Let’s Focus on ‘Modifying or Terminating Conservatorship’. Can you walk us through that process?
Ted: “That’s an important aspect because conservatorships aren’t intended to be permanent. Courts typically conduct scheduled reviews to assess whether the conservatorship is still necessary. Anyone involved, including the conservatee themselves, can petition for termination if circumstances have changed and the individual has regained capacity to make decisions. Sometimes a new conservator might be appointed if the current one is unable or unfit to serve.”
- Courts are very careful about making sure a conservatorship only lasts as long as it’s truly needed.
- “It’s all about balancing protection with autonomy,” Ted explains.
