- Case Assessment: We identify the legal issues at hand, gather evidence, and assess the level of risk.
- Protective Actions: Depending on the severity, we might seek restraining orders, contact Adult Protective Services (APS), or even pursue guardianship.
- Legal Proceedings: If necessary, we’ll file lawsuits for financial abuse, negligence, or personal injury.
- Long-Term Planning: We work with clients and their families to develop estate plans, advance directives, and ongoing oversight strategies to prevent future issues.
Let’s dive deeper into “Protective Actions.” What are some of the things you might do in this stage?
Well, this is often where we have to act swiftly. Imagine a scenario where an older individual is being financially exploited by a family member. We might need to freeze their bank accounts to prevent further loss. Or if there’s physical abuse, we could seek a restraining order against the abuser and arrange for the senior to be moved to a safer living environment.
Sometimes, guardianship or conservatorship becomes necessary, especially if the individual lacks the mental capacity to make sound decisions about their own care. This is a complex legal process where the court appoints someone trustworthy to manage their affairs.

There was another case where a caregiver seemed genuinely concerned about their elderly client, but we uncovered hidden financial transactions. It was heartbreaking to realize someone in a position of trust had taken advantage.
