Firstly, they allow you to control how and when your assets are distributed after your passing, ensuring your wishes are honored. Secondly, trusts can help avoid probate, a lengthy and often expensive legal process. Consequently, your loved ones can inherit your assets more quickly and efficiently. Moreover, trusts offer a degree of privacy not available with wills, as they are not part of the public record.

That sounds incredibly beneficial. Are there different types of trusts? Which type is most common?

You’re right, trusts come in various forms to address specific needs and goals. The most common type is the Revocable Living Trust. With this trust, the grantor retains control over their assets during their lifetime and can make changes as needed. It becomes irrevocable upon the grantor’s death.
This type of trust is popular because it offers flexibility and avoids probate. However, there are other types of trusts tailored to unique situations, such as Irrevocable Trusts for asset protection or Charitable Trusts for philanthropic goals. The best type of trust depends on your individual circumstances and objectives.

That’s helpful information. Could you elaborate more on the benefits of a Revocable Living Trust? For instance, what happens to the assets held within the trust after the grantor passes away?

Certainly. A key benefit is that upon the grantor’s death, the assets in the trust are distributed directly to the named beneficiaries according to the grantor’s instructions outlined in the trust document. This bypasses probate entirely, saving time and expense for your loved ones.
Let me share a situation I encountered recently. A client had created a Revocable Living Trust but unfortunately passed away unexpectedly. His family was incredibly grateful that he had taken this step. Because his assets were held in trust, they were able to inherit them quickly and without the hassle of probate court. They mentioned it made an already difficult time much easier to bear.
Another advantage is privacy. Probate proceedings are public record, but trusts remain confidential. This can be particularly important for individuals who value discretion or have complex family dynamics.
