Setting the Stage
Good morning San Diego! Today we are joined by renowned San Diego Probate Attorney, Steve Bliss, of San Diego Probate Law. Steve has generously agreed to shed some light on the often-complex world of estate planning and provide us with valuable insights for our viewers.
The Importance of Selecting an Executor or Trustee
Steve, thank you so much for being here today. For those unfamiliar with the term, could you please explain what an executor or trustee does?
“Certainly,” Steve responds, leaning forward in his chair. “An executor is appointed to handle your affairs after you pass away if you have a will. They are responsible for tasks like paying debts, filing taxes, and distributing assets according to your wishes outlined in the will. If you choose to set up a trust, then a trustee takes on this role while you’re still alive, managing assets for beneficiaries according to the terms of the trust.”
He continues, “Selecting the right person is crucial. It requires someone trustworthy, organized, and capable of handling financial matters. Ordinarily, people choose close family members or friends, but it’s essential to consider their capabilities and potential conflicts of interest.”
Consequently, Steve emphasizes the importance of open communication. “Discuss your expectations with the person you intend to appoint. Explain the responsibilities involved and ensure they are comfortable taking on the role. It can be a significant undertaking.”
Challenges and Considerations
“Have you encountered any issues with people selecting executors or trustees?” I inquire.
Steve pauses thoughtfully, recounting an instance where siblings disagreed over who should manage their parents’ estate, resulting in prolonged legal battles and strained family relationships. This highlights the importance of careful consideration and clear communication when making this decision.
“I recall another case,” Steve adds, “where a client named a close friend as trustee, but unfortunately, that friend faced unforeseen financial difficulties shortly after. It underscored the need to have contingency plans in place.”
According to a 2019 study by the AARP, nearly 60% of Americans do not have a will or estate plan. This statistic underscores the urgency of addressing this crucial aspect of our lives.
